8.Approval of report and recommendation regarding civil action against Clay County (United States of America, acting through the United States Department of Agriculture, Rural Development v. Mark Wilson, et al., Clay County Circuit Court Case No. 2018-CA-344)
The County was served on May 4, 2018, as a defendant in the above-referenced case in which the Plaintiff seeks to foreclose a mortgage dated April 11, 1991, which mortgaged certain real property located in Clay County, Florida.  See attached memorandum.

The Finance Department business is submitted to request approval and ratification by the Board for various warrants and disbursements in order to meet the requirements of Ch. 136.06 (1), Fl Statute. Acceptance and disposal of various Board property and various documents are submitted for the Board's information. At times, approval is requested for various finance related issues.

Approval of Professional Services Agreement between Fourth Judicial Circuit, Clay County and Nicholas Jason Hadley d/b/a SysArch for the Clay County ICMS Connector Project, as directed by Chief Judge Mahon. 13.Final Public Hearing to Consider Rezoning Application PID-18-01 IA to PID 43 Sleepy Hollow Road (PC Vote 5-2 to Approve)
Rezoning PID-18-01 IA to PID for permitted and conditional uses. Commission District 1 (Commissioner Cella)
14.First Public Hearing to consider transmittal of CPA 2018-03 Overwatch (P.C. voted 7-0 to approve)

Application to amend 2025 Comprehensive Plan,  Conservation Policy 2.1a. and Community Facilities Policy 8.1 regarding setbacks from the Ordinary High Water Line or Mean High Water Line.  Planning Commission voted 7-0 to approve on May 1, 2018.

15.First Public Hearing to consider transmittal of Large Scale Amendment CPA 2018-02 CR 315B Residential

Consider amending the land use from Rural Residential to Rural Fringe, on 26.45 acres located on CR 315B.  The proposed amendment will be a large-scale amendment.  It is located in the Green Cove Springs Planning District and Commission District 5, Mr. Hendry.  Planning Commission voted 7 to 1 on May 1, 2018 to approve CPA 2018-02.

16.Final Public Hearing to Consider Adoption of Text Amendments to the Lake Asbury Master Plan, CPA 2018-01
Consider Adoption of Comprehensive Plan Amendment 2018-01 which addresses the award of density for required wetland-upland buffer land dedications within the Lake Asbury Master Plan area and also includes policy revisions proposed in the Evaluation and Appraisal Report process that were held constant to permit further study of this issue.  (Commission District 5, Commissioner Hendry)
17.Final Public Hearing to consider adoption of Amendment to the Land Development Code to allow the County to Resume Driveway Maintenance Responsibility (P.C. voted 7-0 to approve)

The proposed amendment to the Land Development Code would allow County staff to resume driveway maintenance responsibility with respect to driveway surface and drainage culverts.(Planning Commission voted 7-0 to approve).

22.Division of Historical Resources Grant Application
Approval to apply for Department of State Historic Preservation Grant funding through the Division of Historical Resources for the Clay County Historical Courthouse Roof Restoration Project.  The grant application is in the amount of $100,000 and requires a 50% match ($50,000). The grant application deadline is June 1, 2018 and requires that the application be filed on-line. Staff is still in the process of finalizing the grant application as photos, support letters and historical information must be included in the grant application.
23.State of Florida, Division of Emergency Management Subaward and Grant Agreement

Approval of the Federally-Funded Subaward and Grant Agreement with the  State of Florida, Division of Emergency Management  for Public Assistance related to Hurricane Irma in the amount $232,466.56 (Category B, Emergency Protective Measures).  Additional authorization is requested allowing the County Manager (via letter) to execute this Agreement and all future FDEM Agreements pertaining to additional Hurricane Irma reimbursements. Approval to waive the Purchasing Policy as it may apply as well as approval of accompanying Budget Resolution is also requested. Funding Source: Revenue

LETTERS FOR ACTION
26.Acceptance of Resignation from the Historic Preservation Board - Cynthia Stone
Cynthia Stone informed the Historic Preservation Board on May 9, 2018 that she would be resigning from her At-Large Seat on the Historic Preservation Board.  Ms. Stone has served on the Historic Preservation Board since May of 2003 and her term will expire on July 1, 2018.
27.Discussion of Appointment to the Tourist Development Council

At the May 17, 2018 TDC meeting, the Council unanimously recommended having Gi Teevan fill the vacant Citizen Seat previously held by Kelly Mosley.  The TDC is requesting Board action to appointment Ms. Teevan to fill the Seat.
