SUBJECT: The attached resolution is the next step in the process of enforcing Article XIII, of the Clay County Land Development Code, the County’s Floodplain Management Regulations. After the County declares a property to be in violation, FEMA has the authority under Section 1316 of the National Flood Insurance Act to deny flood insurance coverage to the property. FEMA considers this a remedial measure. Once the declaration under Section 1316 is issued by FEMA, the County will not be required to take additional actions to correct the violation. The declaration may be reversed at any time if the structure is brought into compliance.
