SUBJECT: The applicant is requesting a change to the Land Development Code to add two additional types of Development Agreements to address issues above and beyond what are currently allowed to be addressed in Development Agreements

BACKGROUND INFORMATION:
Chapter 163, Florida Statues, allows local government to enter into development agreements.  Section X of the County’s Land Development Code addresses development agreements.  The primary focus of the County’s existing development agreement provisions is the timing of infrastructure pursuant to concurrency review and proportionate share requirements.  The applicant has applied to modify the Land Development Code to expand the intent of Development Agreements to address phasing issues, timing of mitigation payments, etc.
