BACKGROUND INFORMATION:
The attached agreement is a restatement of an impact fee credit agreement entered into between the County and AFI Associates, Inc., over ten years ago for impact fee credit arising out of transportation improvements made pursuant to the Development Order for the Argyle Forest Development of Regional Impact. This agreement updates the prior agreement in light of the County’s new transportation road impact fee ordinance. Florida law requires that DRIs shall receive impact fee credit for their mitigation of the regional impacts arising from the Development of Regional Impact. The transportation improvements for the Argyle Forest DRI have been in place for many years. The Agreement also approves 11 vouchers already authorized by AFI for the use of impact fee credit within the boundaries of the DRI. This impact fee credit cannot be transferred for use on development outside the boundaries of the DRI. There is no budgetary impact to the County from this Agreement.
