| DATE: 10/2/2018 | | | FROM: Edward Lehman | | | | SUBJECT: Staff is proposing to amend Article IV of the Land Development Code to change the impact area for projects required to do a major traffic study. The impact area is now one mile. Staff recommends that it be expanded to three miles, which is what it was when the traffic concurrency requirements were first adopted.

| | | | | | | | BACKGROUND INFORMATION: | Clay County adopted Ordinance 2006-40 to allow for fair share payments in situations where a proposed project does not meet transportation concurrency requirements, consistent with Chapter 163, Florida Statutes. Any proposed project that generates more than 400 daily trips is required to submit a major traffic study to determine its impacts. Ordinance 2006-40 identified the impact area as three miles for a major residential project and two miles for a major non-residential or mixed use project. Ordinance 2008-45 modified the fair share ordinance and lowered the impact area for any major project to one mile. |
