SUBJECT: Release of a portion of an lateral ditch easement lying within the property boundry of Magnolia West, a D.R. Horton Development.

BACKGROUND INFORMATION:
The existing lateral ditch currently maintained by Clay County is within the boundary of the Magnolia West property.  The new development has engineered and accepted the downstream flow from this easement.  DR Horton has requested the County to release a portion of the easement that extends beyond the wetland boundary once the subdivision drainage system picks up the ditch flow.
