SUBJECT: Variance to Article III, Sec. 2-13(f)(4) to reduce rear setback from 35 to 29 ft. 8 in. in the AR zoning district.

BACKGROUND INFORMATION:

The subject parcel is Lot 3 of the Camp Brooklyn subdivision which was platted in 1947.  According the County Property Appraisers information the residential unit was built in 1959 which was prior to zoning regulations in the County. The associated deck was built in 1988 according Property Appraiser information.  The applicant/owner desires to provide a roof covering for the existing deck.  In 1988, the AR zoning district regulations stated that the applicable lot and building regulations did not apply to lots recorded prior to October 23, 1973.  This parcel was recorded as Lot 3 of Camp Brooklyn subdivision in 1947.  Therefore, the deck did not have to comply with the rear setback for the zoning district.
